1. Service scope
ByteImp provides website engagement software, workspace configuration tools, analytics views, and support related to implementation and operation of the product. Exact scope depends on the selected plan, activated domains, and any separately agreed onboarding or implementation work.
2. Accounts and access
The customer is responsible for keeping login credentials secure, providing accurate business details, and managing who has access to the workspace. We may limit, suspend, or revoke access if the service is used unlawfully, abusively, or in a way that threatens platform stability, security, or other users.
3. Billing, renewals, and Paddle
Paid subscriptions are billed through Paddle, which acts as merchant of record for checkout transactions. Subscription period, recurring amount, taxes, and renewal timing are shown during checkout. Unless canceled before the renewal date, subscriptions renew automatically for the next billing period at the then-applicable standard renewal price.
4. Acceptable use
The service may not be used to collect unlawful data, impersonate third parties, send spam, violate intellectual property rights, or process content that is illegal, abusive, deceptive, or harmful. The customer remains responsible for website content, deployment decisions, notices shown to visitors, and any data collected through their own website flows.
5. Custom work and non-standard services
Implementation work, migration work, advisory services, and other custom deliverables may be offered separately from the Paddle subscription checkout. Unless a separate written agreement states otherwise, such work is scoped individually, billed separately, and governed by the agreed commercial terms for that work.
6. Intellectual property
All rights to the ByteImp software, branding, documentation, and service materials remain with K2 Software Krzysztof Kubik or its licensors. The customer retains rights to their own website content, source materials, and business data. No transfer of ownership occurs unless expressly agreed in writing.
7. Availability, warranties, and liability
ByteImp uses reasonable efforts to keep the service available, secure, and accurate, but does not guarantee uninterrupted operation or any specific commercial result. Except where mandatory law states otherwise, liability for claims related to the subscription service is limited to the fees paid for the affected subscription period.
8. Termination
The customer may stop using the service at any time and may cancel future renewals before the next billing date. We may suspend or terminate access in case of non-payment, unlawful use, security threats, or material breach of these terms. Termination does not automatically create a refund right unless stated in the refund policy or required by law.
9. Governing law and contact
These terms are governed by Polish law, subject to any mandatory consumer protections that apply in the customer's jurisdiction. Unless mandatory law provides otherwise, disputes will be resolved by the court competent for the registered place of business of the seller, currently the district serving Szczercow and Piotrkow Trybunalski. Questions about these terms may be sent to [email protected].
